The Supreme Court will on Tuesday, May 9, at 2pm deliver judgment in the disputed governorship election held on July 16 in Osun State.
The Apex Court fixed the date on Monday after taking arguments from parties involved in the matter.
At the centre of the disputed election are the incumbent governor, Ademola Nurudeen Adeleke, who contested the poll on the platform of the People’s Democratic Party, PDP, and Adegboyega Oyetola, who was the All Progressives Congress, APC’s candidate in the poll.
While Oyetola is the appellant in the matter, having lost at the Court of Appeal, Adeleke is the major respondent who won at the Appellate Court.
The Court of Appeal, sitting in Abuja, had on Friday, 24 March vacated the tribunal judgment that nullified the election of Governor Adeleke.
The appellate court, in a unanimous decision by a three-member panel of justices, held that the appeal Adeleke lodged to challenge his sack by the Osun State Governorship Election Petition Tribunal was meritorious.
Aside setting aside the judgment of the tribunal, the Court, in its lead judgment delivered by Justice Mohammed Lawal, awarded N500,000 cost against the APC and its candidate, Oyetola.
At today’s proceedings, Prince Lateef Fagbemi, SAN, argued for the APC.
