Tinubu Records First Victory, As Tribunal Struck Out Petition Challenging His Election

President-elect, Bola Ahmed Tinubu on Monday, recorded his first victory at the Presidential Election Petition Tribunal, PEPT, with the dismissal of the Action Alliance, AA’s petition, challenging his victory at the 2023 poll.

The five-member panel of Justices Haruna Tsammani, Stephen Adah, Bolaji Yusuf, Moses Ugo and Abba Mohammed struck out the petitioner’s case, following the withdrawal of its petition.

Ruling on the application for withdrawal, Presiding Judge, Justice Tsammani held that the dismissal was in line with the provisions of the Electoral Act.

Earlier, the lawyers, representing different factions of the political party had claimed they have been instructed by the factions to withdraw the petition.

The party’s presidential candidate, David Okonigbuan had filed the petition against the Independent National Election Commission, INEC; the All Progressives Congress, APC; President-elect, Bola Tinubu and Hamza Al-Mustapha, challenging his exclusion from the election.

The Action Alliance had also fielded Al-Mustapha, as its Presidential candidate, who was listed by INEC.

The respondents in the matter did not object to the withdrawal of the petition.

With this development, there are just four petitions left before the tribunal for hearing and decision.
